Becoming a State National: Facts, Misconceptions, and Lawful Process Explained

Updated: Aug 20, 2025

You’re not crazy for asking. In fact, asking these questions might be the first real act of freedom you’ve ever taken.

Maybe someone mentioned “Becoming a State National” in passing. Maybe you saw a video that claimed you don’t really have to pay taxes, or that the government’s been tricking you since birth. Maybe it all sounded a little wild — or maybe it clicked deep in your spirit.

But now you’re curious. And maybe a little confused.

b: that confusion is normal. Most Americans have never been taught about political status correction — not in school, not by the media, and certainly not by the government. Why? Because the system depends on your ignorance to keep you compliant.

If you’re just now discovering this idea — the notion that you might have been pledged, without full knowledge or consent, into a federal jurisdiction that limits your God-given rights — you’re not alone. Tens of thousands of Americans are waking up every year and asking: “What am I really consenting to? And how do I lawfully opt out?”

What Is a State National?

A State National is not a rebel, a conspiracy theorist, or someone trying to break the law.

A State National is someone who has learned the lawful difference between being a 14th Amendment “U.S. citizen” — a federal franchise, subject to corporate statutes — and being a natural-born national of the State where they were born or live, with rights protected under the original Constitution and common law.

It’s someone who has used due process — affidavits, notarization, service, and recording — to remove their presumed consent and return lawfully to the Constitutional Republic.

It’s someone who understands that rights come from God, not from government. As declared in our founding document:

“All men are created equal, that they are endowed by their Creator with certain unalienable Rights.” — Declaration of Independence, 1776 (Source)

If you believe in those words, then the State National path is not just your option — it may be your duty.

Misconceptions on Becoming a State National

Misconception #1: “Is This Even Legal?”

This is often the first question people ask — and it’s a fair one. With so many scams and half-truths floating around the internet, it’s natural to wonder whether correcting your political status and declaring yourself a State National is actually lawful.

The short answer is: Yes. It’s 100% lawful, peaceful, and protected by both constitutional and international law.

Your Right to Change Political Status Is Protected by Law

The legal foundation of becoming a State National lies in the universally recognized right to self-determination. This principle is not fringe theory — it’s enshrined in binding international agreements and echoed in the highest laws of the United States.

Here are the core lawful authorities that protect your right:

Source of Law

Right Affirmed

Universal Declaration of Human Rights (1948)

Article 15: Everyone has the right to a nationality... and the right to change it.

International Covenant on Civil and Political Rights (ICCPR)

Article 1: All peoples have the right of self-determination.

U.S. Declaration of Independence

The people have the right to alter or abolish any form of government that becomes destructive to liberty.

U.S. Constitution - First and Tenth Amendments

Protects religious liberty, speech, conscience, and the sovereignty of the people and States.

These legal frameworks affirm your God-given right to choose your political allegiance — especially when it becomes clear that your presumed “U.S. citizen” status binds you to obligations and jurisdictions you never knowingly agreed to.

How the Lawful Process Works?

Correcting your political status is not about breaking laws or evading responsibility. In fact, it’s the opposite: it’s about reclaiming your proper standing within the law — not under commercial codes, but under constitutional and common law.

The lawful process includes:

  • Affidavit of Rebuttal and Repudiation of Citizenship (AOR): A sworn, notarized statement that lawfully removes your consent to 14th Amendment status.

  • Notarization: Provides the lawful verification of your identity and intent.

  • Certified Mail with Return Receipt: Serves your affidavit to the Secretary of State, creating a chain of evidence.

  • Default Judgment: After 22 business days with no rebuttal, you issue a lawful Notice of Default.

  • Public Recording at the County Clerk: Your affidavit becomes part of the public record — admissible in any court.

This is called due process — a fundamental right under the Constitution — and when followed correctly, it creates a lawful and enforceable correction of status.

What Makes This Different From “Paper Terrorism” or Theory?

You may have heard of other movements or filings that get labeled as “sovereign citizen scams” or “paper terrorism.” That label gets unfairly applied when people try to assert rights using the wrong tools, unverified documents, or aggressive behavior in courtrooms.

What State Nationals Rock teaches is measured, lawful, and strategic. Every document is structured for legal admissibility. Every step follows due process. And every action is peaceful, non-adversarial, and spiritually rooted.

In short: this isn’t about fighting the system — it’s about lawfully stepping outside the false system you never agreed to.

Misconception #2: “Will I Lose My Social Security, VA, or Retirement?”

One of the most common fears people have when learning about political status correction is: “If I become a State National, will I lose the benefits I’ve worked my whole life for?”

The answer is: No — unless you actively choose to revoke them.

These Are Private Contracts — Not Government Gifts

Social Security, VA benefits, pensions, and retirement accounts are contractual obligations made with the legal fiction known as your ALL CAPS NAME — the corporate entity created when your birth certificate was registered.

When you become a State National, you are not destroying or erasing that ALL CAPS NAME — you are simply reasserting your lawful standing as the living man or woman behind it, and taking rightful control of it.

Unless you specifically serve notice to revoke or repudiate these benefit contracts, they continue as promised. You are still the beneficiary — just no longer the collateral.

You Keep What You’ve Paid Into

If you’ve paid into Social Security or earned VA benefits through military service, those cannot be lawfully taken from you unless you renounce or cancel them in writing.

Most State Nationals:

  • Continue to receive Social Security

  • Keep their retirement funds

  • Maintain access to their VA benefits

Becoming a State National is not about living “off grid” — it’s about living lawfully, with honor and control over your rights.

Becoming a State National

Misconception #3: “Does This Mean I Don’t Have to Pay Taxes?”

Let’s clear this up gently and responsibly.

Becoming a State National does not automatically exempt you from taxes. However, it does change the legal classification under which the IRS and federal entities view you — and that opens the door to lawful restructuring.

Understanding Tax Status: “U.S. Citizen” vs. “Non-Resident Alien”

Most Americans are presumed to be 14th Amendment U.S. citizens, which makes them subject to:

  • Federal income tax

  • Corporate jurisdiction

  • Administrative law

But once you correct your political status, you are lawfully reclassified as a “non-resident alien” for federal tax purposes — meaning:

  • You do not reside in the federal jurisdiction

  • You are not a corporate franchise of the UNITED STATES, INC.

  • You are not obligated under the Internal Revenue Code unless you consent through contracts (like W-4s)

This is supported by the IRS’s own definitions, as outlined in:

  • IRS Publication 519: U.S. Tax Guide for Aliens

The key point? You have to take lawful steps to revoke consent and restructure your filings. This includes:

  • Filing a Form W-8BEN (for individuals not subject to withholding)

  • Sending a properly executed Affidavit of Status (AOS) with IRS Form 56

  • Removing or closing prior taxpayer elections

The Case of Joseph Banister: A Turning Point

Former IRS Special Agent Joseph Banister investigated the legality of federal income tax obligations — and found no law compelling the average American to file. He was criminally charged in 2004 — and acquitted by a jury in 2005, after proving the IRS could not cite a law making filing mandatory.

A Word of Caution

Every individual is responsible for their own financial decisions. While State Nationals Rock provides the education and tools, we do not offer legal or financial advice.

What we can say is this: status correction gives you the legal standing to assert your rights — including your right to restructure your tax relationship lawfully.

Misconception #4: “Will This Fix My Court Case?”

This is one of the most sensitive and misunderstood topics in the State National journey.

If you’re facing legal trouble — whether it's a ticket, a charge, or a full-blown court case — the idea that correcting your status might make it disappear can sound like a miracle. But here’s the truth:

Status correction is a shield — not a time machine, and not a magic wand.

What Status Correction Actually Does

Correcting your political status lawfully removes your presumed consent to federal corporate jurisdiction. That means:

  • You are no longer considered a U.S. citizen subject to administrative courts.

  • You are now standing as a man or woman under the Constitution — not a legal fiction.

But… this doesn’t automatically erase pending court matters. Why?

Because the court already believes it has jurisdiction — unless you lawfully challenge it.

The Formula: Correct Status + Lawful Strategy

To effectively stand in a court or defend against legal actions, you need two things:

  1. Lawful Status Evidence — notarized, served, and recorded documents showing your correction.

  2. Strategic Defense Tools — filings, responses, and procedures that challenge jurisdiction or rebut claims.

Without status, you’re just another defendant.Without lawful strategy, your corrected status may never be seen.

That’s why we recommend using the Due Process Defender AI — a private, secure legal assistant built to help State Nationals:

  • Respond to court summons

  • File the right motions

  • Challenge jurisdiction lawfully

Misconception #5: “What If I’m a Naturalized Citizen or Was Born Abroad?”

This is another big one — and the answer may surprise you.

If You’re a Naturalized U.S. Citizen…

Yes — you can correct your political status.

When you became a naturalized U.S. citizen, the contractual allegiance from your birth nation was transferred into the corporate system of the United States. That means you are in contract — and contracts can be lawfully revoked.

Your Affidavit of Rebuttal (AOR) will need to reflect:

  • Your naturalized citizenship

  • The transfer of national allegiance into federal jurisdiction

  • Your lawful choice to withdraw consent and reclaim status as a national of your resident State Republic

The rest of the process remains largely the same: notarize, serve, wait, default, and record.

If You’re a Green Card Holder or Non-Citizen

This path is still being tested. Here’s why:

Without naturalization, you may not have signed a clear “citizenship contract” with the corporate UNITED STATES. That makes your situation more nuanced.

Currently:

  • Several individuals are experimenting with status correction as lawful residents. The AOR process doesn’t fully apply — because there’s no corporate citizenship to repudiate. Most educators recommend first completing naturalization, and then beginning the AOR process to correct from there.

Until we’ve had documented success with passport issuance for non-naturalized residents, we can’t responsibly recommend that route yet.

If that’s you, reach out to the team directly or book a consultation to walk through your situation with someone experienced in these edge cases.

The Lawful Process in a Nutshell

Becoming a State National begins with one powerful, foundational act of truth:

The AOR: Affidavit of Repudiation and Revocation of U.S. Citizenship

This document is the cornerstone of your lawful process. It is a sworn, notarized affidavit in which you:

  • Declare who you are — a living man or woman, not a corporate entityRevoke your consent to 14th Amendment “U.S. citizen” status

  • Assert your political status as a State National under the Constitution

The 22-Day Service Window

Once notarized, you send your AOR by certified mail with return receipt to:

  • The Secretary of State of the United States (Washington, D.C.)

That mailing is your formal service — and it starts the clock.

Under law, the government has 22 business days to respond and rebut your affidavit. If they do not, you then:

  • Create a Notice of Default Judgment affirming their tacit agreement by silence

  • Notarize and attach your Certified Proof of Service

  • Record everything at your local County Clerk’s office under miscellaneous affidavits

Why Step 1 Is Everything

Your AOR is not just paperwork — it is the legal and spiritual foundation of your freedom.

It’s what turns your private belief into public evidence. Without it, everything else is theoretical. With it, you’ve taken your first lawful step toward reclaiming jurisdiction over your life.

If you don’t do Step 1 right, the rest of your process may collapse. That’s why we offer:

  • Professionally prepared AOR Packages

  • A full DIY membership with instructions

  • Direct support from educators and founders

Don’t rush Step 1 — build it strong, and the rest of your house will stand.

Why This Works (And Why Some Methods Don’t)?

There are many “freedom movements” out there — and not all of them are equal.

We’ve seen it all:

  • State Assemblies asking you to “join their government”

  • UCC-1 filings that promise to “free you from the system”

  • Private letters with red ink, thumbprints, or gold-sealed flags

  • Sovereign citizen scripts that get thrown out in court

Many of these efforts are well-intentioned, but they lack one crucial thing: Lawful due process that courts recognize.

What Makes State Nationals Rock Different?

The process SNR teach is:

  • Based on constitutional authority, not theory

  • Built on notarized affidavits, sworn under penalty of perjury

  • Structured with lawful service, default windows, and public recording

  • Designed for admissibility in court under the Rules of Evidence

It is non-adversarial. It doesn’t fight the system — it removes your consent from it. You are not trying to “beat” the government. You’re saying: “I do not consent to be governed by fraud.” And you prove it — on paper, in public record, in peace.

Tried Something Else First?

If you’ve followed other processes before, you’re not alone. Many of our most dedicated members started with different methods — and later realized those paths couldn’t stand up in court.

There’s no shame in that. You were doing your best with what you had.Now it’s time to start again — with truth, honor, and lawful tools that work.
